KOCHI: The Kerala High Court on Friday issued notice to the vice chancellor of Calicut University on a petition alleging that the appointment was made in violation of UGC norms.
Justice Devan Ramachandran directed for issuing notice to MK Jayaraj, vice chancellor of the university, by special messenger after considering a petition (WP-C No. 335/23) seeking a writ of quo warranto. The petition was filed by T Muhammedali, associate professor at Farook College in Kozhikode, through senior advocate George Poonthottam.
The petition said the vice chancellor is continuing in office despite the chancellor asking him to step down in view of the law laid down by the Supreme Court in the case of the appointment of the vice chancellor of APJ Abdul Kalam Technological University (APJAKTU).
In the case of Calicut University, the appointment of the vice chancellor was on the basis of a recommendation made by a search committee that was constituted in violation of the provisions of the UGC Regulations, stated the plea. Both the recommendation and the constitution of the search committee were in violation of the UGC Regulations, it is alleged by the petitioner.
As a person not duly selected or appointed to the post of vice chancellor, MK Jayaraj is not entitled to continue in the post which is a public office, the petitioner has contended. It is unfortunate that the vice chancellor is seeking resort of the high court for his continuance, the petition said.
